Understanding Jurisdiction in Custody Cases

Simply put, jurisdiction governs a court's right to preside over a case. For a judge to handle a child custody case, that judge's court must have jurisdiction over the custody dispute.

In the U.S., the Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA) helps streamline custody issues by making it easier for a court to determine a child's home state. Family law courts within a child's home state have jurisdiction over custody issues.

How Courts Determine a Child's Home State

Courts generally rule that if a child has lived in one state with a parent or a person acting as their parent for six consecutive months or more, that state is their home state.

In cases where the child has not spent that much consecutive time in one state, the court may designate their home state as whichever state the child has a more "direct" relationship with. Factors such as whether a child attends school in a state, has parents there, and/or has family in a specific location can all play into a court's decision.

Jurisdiction rights can change over time. A child or their parent(s) moving to a different state may impact which court has jurisdiction over a custody case.
