Paternity Attorney in The Woodlands
Team-Based Paternity Representation Focused on Enforceable Parenting Orders
A biological connection doesn’t always establish legal parentage in Texas. Until the relationship is legally recognized, a person may lack an enforceable basis for seeking custody, visitation, child support, or authority over important decisions involving the child. At Diggs & Sadler, we represent mothers, alleged fathers, presumed fathers, and other parents facing disputed parentage concerns. As a boutique Texas family law firm serving The Woodlands, we connect the determination of parentage with the practical orders a family may need.

How Texas Law Establishes or Challenges Paternity
Texas recognizes several routes to legal parentage. The correct path depends on marital history, existing documents or court orders, genetic testing, and whether another person already holds recognized parental status.
A paternity case may involve:
- Presumed parentage: A man may be a presumed father based on marriage or, in certain circumstances, living with the child during the first two years of the child’s life and representing the child as his own.
- Acknowledgment of Paternity: This signed legal document can establish the parent-child relationship without a trial when statutory requirements are met. Texas law limits when and how it may be rescinded or challenged.
- Denial of Paternity: This document may be required when the mother was married to someone other than the child’s biological father. Its legal effect depends on proper execution with the related acknowledgment.
- Court-ordered parentage: A court can legally determine parentage after considering genetic testing and other admissible evidence.
Genetic testing can establish or disprove a biological relationship, but the results may not resolve every legal question. Presumptions, acknowledgments, prior orders, and statutory deadlines can affect whether and how an existing parent-child relationship may be challenged.
Parenting & Support Orders After Paternity Is Established
Establishing parentage and deciding parenting terms are related but distinct steps. A Texas court may address conservatorship, which covers parental rights and decision-making authority, as well as possession and access, the legal terms governing when each parent spends time with the child.
Depending on the facts and requested relief, related orders may cover:
- Conservatorship and decision-making rights
- Possession and access schedules
- Current or retroactive child support when authorized
- Medical and dental support
- Certain pregnancy-related or post-birth health expenses
We consider these issues together rather than treating the parentage finding as the end of the case. Our team prepares each matter for the possibility of litigation while pursuing negotiation or mediation when either approach fits the client’s circumstances.
Contested Paternity & Parental Rights
Disputes may involve conflicting claims, contested testing, a prior Acknowledgment of Paternity, or an existing order naming a legal parent. An alleged father may have different legal options from a presumed, acknowledged, or adjudicated parent.
High-conflict cases may also involve allegations of abuse, substance use concerns, or a child with special needs. Depending on the evidence and statutory requirements, temporary orders may address support or possession and access while the proceeding continues.
Founder Cindy Diggs is Board Certified in both Family Law and Civil Trial Law. Our attorneys prepare for hearings, depositions, mediation, trial, and appeal when the case requires them.
How We Build a Paternity Case Strategy
We begin by identifying existing legal relationships and the orders you need. That review allows us to develop a case-specific strategy rather than assuming every dispute should follow the same path.
Our review may address:
- Family history: We examine the child’s birth, the parents’ marital history, and anyone who may qualify as a presumed parent.
- Existing records: We assess acknowledgments, denials, genetic test results, prior court orders, and related filings.
- Parenting issues: We identify disputed questions involving conservatorship, possession and access, support, or temporary relief.
- Procedural strategy: We prepare for filing, service, required disclosures, negotiation, mediation, hearings, or trial as appropriate.
