How Does Custody Work in International Cases?
International child custody cases often involve either a child from another country or parents who reside in different nations that wish to share custody of a child.
Generally, whichever court claims jurisdiction over the custody case will use the family law code specific to that court's country or state to govern the child custody arrangement.
Like adoption and parental kidnapping cases, the Hague Convention plays a large role in international custody cases. According to the Convention, child custody in international cases should be established in the child's "habitual residence."
Parents who want to establish custody using Texas Family Code should consider keeping evidence on hand showing that their child primarily lives in Texas. This can include U.S. identification such as a birth certificate, grade transcripts from a U.S. school the child attends, and medical records established in the U.S. for the child.
If a parent unlawfully takes a child to another country during a custody dispute (or after establishing custody), the court can also utilize the Hague Convention to enforce the terms of the custody arrangement if both countries involved in the case abide by the Convention.
